Hi,
I was working with company# A as Electronics Engineer from Dec ’03 to Jan ’07 on H1B visa, Company# A filed my GC in May ’05 (as Electronic Engineers (Except Computer), 172072.), then later I got very good opportunity in IT field, I quite Company# A and joined Company #B because I build very good relation with Company #A and there were ready to continue my GC file. In August ’07, I filed I-485 (I got EAD based on pending I-485). Now Company #B giving me lay-off, so my question is –
Company# A still want to hire me after I got GC (because they were very happy with me, right now they don’t have position to hire me back), In this case can I continue working in IT field on EAD status (right now I am on H1B). My current (IT) and Labor profile are both different.

Your GC is sponsored by company A for "Electronics Engineer"
Your new job in IT would be neither 'Same' nor 'Similar' to the GC job.
So you cant use EAD to work invoking AC21.
You can find new employer who can sponsor H1 though and work in IT.

I am looking to accept a new full time position on H1b with a company other than my current employer. My current employer has offered me to continue with them on a partime basis with a concurrent H1 and I am looking to convert my current full time H1 into a part-time H1 and get the new company to file a new concurrent H1 petition for me for full time. There is no change in title or job description.
My question is whether changing a full time H1 into a part time (40 hrs/wk vs 20 hrs/month) constitute a material change ? and thus require filing of a new ameneded petition ? And are the filing fees same for an amended petition as for a new petiton.
Would appreciate if someone knowledgeable would comment.

Thanks , but i already using OSCommerce from technical standpoint but i had some operational questions,let me know if you have a ecommerce site.
If you are looking for a ready-made solution - Volusions and a few other options are out there.
If you are computer savvy you can also use Drupal and other pre-built solutions and customize using smart cart and payment processing packages.
Writing everything from scratch may be a waste of time if online retail is your goal.

I am an F1 visa student and am marrying my sweetheart who is an American citizen. We are planning to pick up the marriage license tomorrow, in MA. I know one of the questions is "residence". Do I put my local residence (I've been here for about 6 years) or my foreign residence? I do not want to jeopardize my status.

1) If I take the H1b extenstion for three years (based on my pending I-485) and let say after one year, I start using my EAD with a new employer and my previous employer revokes my H1B....Will I be able to get back on H1B if my I-485 petition get denied for any reason. All I am trying to see if anything happens to my I-485 petition, will I be able to go back on H1B from EAD.
If your 485 is denied, you will not be eligible for any more H-1B time until you have spent one full year outside the US. You have already used your full 6 years and are only entitled to extensions now because you have an approved I-140 and a backlogged priority date. If these conditions apply even after a 485 denial, you could regain H-1B status, however it depends on the grounds of the 485 denial.

The airline persons asked for I-94 when I checked in.
I feel it is safe to turn in both I-94's when you leave, after making a copy. I also feel, it is not a big issue.

I am now "current" with Nebraska and the latest Visa Bulletin. I have completed all other hurdles (including finger printing) how long should I expect now to wait now for my green card to be adjudicated ?
Also, I have no idea about the FBI name check.. How do you even know if your file is being held up because of an FBI name check ?

And

Perhaps some of you had a similar experience and can kindly share how long you waited in the final step for the GC once you were "current".

Will it be better to find another Job and go EB2? My H1b started in Oct 2007.
If you qualify for EB2 then obviously go for EB2 (as its current). If you dont have a masters and have only say 2 years of experience, then instead of wasting 3 years waiting for EB2, start a GC in EB3. Once you get past I-140 the PD becomes yours. Now whenever you jump jobs and file GC again (in EB2 say) you will get the 2008 PD. So even if EB2 retrogresses in the future, you would have saved yourplace in ht equeue.

Employer needs to stop smoking weed and concentrate on work. Jokes apart there was no such proposal ever in pipeline so there is no way anything like this ever was approved. 6 year limit on H1 is a law that cannot be changed by admin process. It needs to pass house & senate. Also 6 year limit makes lot of people go back to home countries and uncle sam can consume their SS & Medicare taxes.

Company A applied for GC citing future employment.
Got the EAD.
Currently I am in the pay roll of Company B(sister concern of A) in H1.
What are the things I have to do if I have to work in EAD? Can I use AC21 and move on? Do I have to work for Company A atleast for sometime?
