Hello,
Here's my situation:
H1b: 7th Year (valid through Nov 2009)
Labor: Approved
140: Approved
Category: EB2
Priority Date: Aug 2007
485/EAD: cannot file due to retrogression
I have a permanent employment offer from the employer where I am contracting, right now for the same job. Following are the questions I have:
1. Can I change my employer?
2. Can I retain my Priority date?
3. If the new employer files for transfer of H1, what does it mean to my extension beyond 7th year?
Please help.

Although the job descriptions are pretty similar ( C coding, design, protocols etc.), my PERM was filed for Computer Software Engineer-Applications whereas the new one falls under Computer Software Engineer, Systems Software. Is this a risk during I-485 adjudication. Also my new salary is 50% higher than my original PERM salary (It has been almost 4 years since my original PERM).

Thanks validIV for your reply.. I spoke to couple of attorneys regarding that.. one said its illegal and dont want to talk about it, other said that's the only option for my wife to go to job since she doesn't have an EAD.

Yes I got the mail too and it says the same word to word. No surprise there.
We would need to educate the problems to the Senators. They seem to think anything related to immigration like a tunnle view. Just one thought and one decision and that is wrong.

Friend of your's needs to carefully look at that page of the passport again.
One of the following would be corssed out (or marked deleted)
(1) ECR: Emigration Check Required (for all countries except Bangladesh, Pak, North America and Europe)
(2) Emigration Check NOT Required.
If ECNR is not deleted, then there is no problem. If it is delted, there is still no problem in coming to the US (In my passport, ECNR was deleted, and I had no problem in leaving India for the US).
If ECR is not deleted, then emigration check is required only if you are travelling to countries that are not in the list of exceptions in (1).

Friend of mine has got H1B1 visa stamped now. But we just found out that on his passport ECNR is not deleted. ECNR is still required there.
Can you guys help us to understand what this is? Do we need to remove ECNR before he travel to UR? He has BE (Mech).
When I came to US my ECNR was deleted and I am also graduate.

My I140 (and I485) were filed in May 2010 (EB2, NSC). My attorney just notified me they received an RFE regarding my eduction. Apparently USCIS needs more details on my MSc degree from Poland (integrated, 5 years) and explanation why is it equivalent US masters degree.
Has anyone had a similar hurdle when filing under EB2 with a degree like that? Should I be terribly worried about getting my I140 approved or do cases like that normally go through (provided that an RFE is correctly replied to)?

Hello
I am working on a L1 B Blanket Visa since the past 3 years. My visa is expiring on 11/18/08 and my employer encourages me to apply for a fresh petition from India rather than apply for an extension here due to the no. of cases denied. My wife is presently employed through EAD which expires the same date.
Is there any way that she can retain her employment while we both get our VISA stamped a month before my current VISA expiry date from India ? She might not get 2 months leave without pay which is the usual processing time for a re-extension of EAD considering we both arrive in US after getting a new VISA in the first week of November 2008. Please advise.

Yes,probably it will be a mistake.Tell your Employer or Attorney to the get the appointment in the local uscis office and sent them the cover letter to uscis saying that we didn't request for I-140 to be withdrawn and we still need that person and want to hire that person in the future.Remember that GC is for your future job.I think so once uscis recieved the cover letter from your employer and attorney you should be fine.Is your I-140 was in process at that time or it was approved earlier.

Simple answer is there is no such thing as a temprorary EAD. There used to be but they were eliminated some years ago.
You will just have to wait and hope. If however, the processing time exceeds 90 days you can take an infopass appointment and the local office will contact the service center to get things rolling.

My 485 application was recieved by R.Cook@NSC too and no receipts or checks cashed yet. My application was delivered on July 18'th. My I-140 was approved on May 11'th 2007 by TSC.

Ok! Thought of starting this thread to track EAD/AP/FP notices and updates for early july filers. This way we can see if there is any kind of pattern going on. My details below:
I-140 cleared from TSC
485 filed july 2nd with NSC
Checks cleared on 9/4 and got RN# starting with SRC (TSC)
USCIS Case update shows "Last update" as 9/3 for EAD/AP.

Actually folks staying in the UAE can apply to the U.S. consulate there even if they are not local citizens of UAE. The disadvantage of applying in the consulate in UAE is that the visa will be slated to expire when the UAE visa expires. Logic being that if your status in the UAE expires, your US visa expires. In addition, chances of rejection are higher since the only local tie you have to the UAE is your job.
I would try to see if you could go to your home country and apply. If it is urgent, then you would want to try the US consulate in UAE.
