    Hi,

    Looking at your current thread and all other previous threads related to the same topic, it seems clear that you have to start calling the concerned department as to why you have not yet received your applicant's green card. Looks like it is being processed as we speak based on the "Note from VB" you have posted. It's still better to call and find out. I am not sure who and what number to call for FB visa enquiries - but the data you give appears that your application is "ripe" for the plucking. There are lots of thread here suggesting how to get an info pass to talk to an Immigration Officer face to face. Search for the threads.

    When you pose a question, can i suggest -
    1. Give all the information that the readers needs to answer. For ex: we don't know which country the applicant is chargeable to.
    2. And give all information in one thread. Make up your mind what your concern is and post the question(s) in one thread. Try not to put some question out there and hope it sticks.

    With not many 'easy' H1b cases anymore. This looks like another route for the 'attorney' to get more clients, selling fear!
    I agree !! it is definitely bad news and many may end up spending more on a plastic card. more business for lawyers !!!
    maybe guiness book of world records should have an entry for the costliest plastic card I just hope and pray that future generations have better options at home and in different countries and links such as these point out the hard truth that everyone needs to have a plan B - and be mobile and ready to move. (i.e. not get stuck with immovable assets).

    In my job search (banking and finance jobs) there is this one question i come across on each and every job application-

    "Do you now or will you in the future require sponsorship to legally work in the united states?"
    and options to tick on the form are 'yes' or 'no' with no space for explanation.

    So i mark 'yes' and i guess thats where my job applications get stuck.

    Should I answer yes or no, since i am on L2 (visa valid for next 2 years) and currently have 2 years Employment Authorisation (EAD) where i can work for any employer in the United States ?

    I understand that companies ask this question because some of them are not allowed/ do not have a policy to sponsor visas.

    I want to know whether i am legally required to say 'yes' because i am on L2 ( since after 2 years, my visa renewal depends on whether or not my spouse's L1 is renewed)

    OR

    Do I still have a choice to say 'no' since my visa renewal gets done if my husband's gets done or i manage it on my own through a consultant... and the company i will join in both cases does not have to sponsor or pay for my visa either now or in the future.

    I do not want to misrepresent any information and get thrown out of the organisation after i join, nor do I want to lose out on opportunities because of answering this question wrongly.

    Let me know please, it'll help a lot.

    As long as you haven't used the EAD/AP for employment purposes, I think your H1 is still valid. If your H1 is still valid then I believe you can get your denpendant's H-4 extended based on our H1 validitiy. But I suggest to contact your company attorney to make sure your H1 is still valid.

    Below are the 2 listed jobs.. I am currently working as 15-1051.00 Computer Systems Analysts for XXX comp... I have been working for more than 3 years.. They are planning to file my GC soon..

    I know for a fact that you cannot count current employer exp for GC. If i start working for the same employer on 15-1031.00 Computer Software Engineers, Applications , is it more than 50% different in role so i can count my 3 years experience when applying my GC ??

    Also do i have to file a new H1 for this 15-1031.00 Computer Software Engineers, Applications job from same employer ??

    All Attorney/ Senior memeber.. please guide me on this..

    1.Is it mandatory to have a pending 485 application in order to get H1b
    extended beyond 6 years using I-140 approval?

    2.Do I need to be with the employer who filed PERM in order to get the H1b
    extended beyond 6 years using I-140 or can a new employer file for my
    extension using the approved I-140( without having a pending 485
    application ) ?

    You can use your 140 approval notice copy to extend beyond 6 years. It does not matter to which employer the 140 belongs to. It is not mandatory that you should have 485 pending.

    If company B is sponsoring your GC, they have to prove that the salary they will offer you after getting your GC, is equal or above the prevailing wage. As long as they are able to do that you should be okay. You just have to go and work for Company B once you get your GC.

    I don't think it matters what you are making right now. This is my understanding.

    I currently work in a big IT consulting firm (company A) thru H1. My uncle owns a very small (less than 100 ppl) consulting shop (company B). I want to join his company, but i dont want to transfer my h1 since B is small and there is lot more job stability in company A. So B is willing to sponsor future employment GC for me.

    I will be joining company B in the same job desc as im working in company A. As it looks right now, I might have to take a small cut in salary to join company B, however im sure that salary difference will be a lot more once it gets to the 485 stages.

    What do you think are the risks as compared to having a GC sponsored through a company where u already hold a H1? I understand that my intention to join might become an issue because of the salary issue, but wouldn't that be the case even if i filed for Company A, since company A would file a LC based on current wage and by the time of 485, I will be making a lot more.

    Hi,

    I am a Doctor and working on EAD. I have a dependent EAD through my husband and PD is June 2002 EB3. As I am eligible to file under EB2, therfore just wanted to know if it is feasible to start my own GC processing under EB2 while working on EAD which was filed under EB3 category ? If its feasible to file another GC then would like to get further clarifications on below few points

    1) Would I be able to port my old priority dates (June-2002) or do I have to file altogether a new application ?

    2) Could there be any intruption to my current EAD or to my husband's EAD by filing a new GC application ?

    3) If I won't be able to port old EB3 priority dates, is it still adviseable to file new GC application under EB2 ?

    Now. Don't try to scream.
    This is just unofficial and don't ask my sources.

    All i know is that as of yesterday there were only 18000 applications for Masters quota.

    Why did not they get filled as fast as the Regular quota?
    This is the reasoning my lawyer gave....

    "Most of the applicants for Master's quota were in confusion after April 3 after reading several bulletins about 200,000 or so H1-B applications. And some people didn't even apply thinking that the USCIS may have received more than enough master's quota applications even though the bulletin said that they were accepting more applications for Master's quota."

    I know of people who have submitted fresh H1-B applications under master's quota as late as April 7th.

    So guys, wait for the official numbers. Don't believe me. But do compare when the official news is released.

    I am surprised by the slow pace of Master's applications.

    Yes. U have to file a G28 for ur spouse. I am in a similar situ and am in the process of doing so myself.

    As for the actual porting, did u do an H-1 transfer or did u start at ur new company using ur EAD? If u did transfer over ur H-1 did u wait until u got the actual USCIS receipt to start work?

    Does anyone know what what legal expenses one might ...once form G-28 is filed for a new lawyer to represent an applicant (I-140 has been approved and I-485 was filed more than 180 days ago)??

    I have used AC21 to switch employers. I also changed attorney using G28.

    Do I need to file G28 for my spouse as well for the new attorney?

    One year for my labor had not elapsed and I had no other way to get the 8thyr extension so my attorney applied for the premium processing, it was applied on 16th and got it approved by 27th of June. If your labor has met the 1yr req. you could always apply for the 1yr extn, don't see why you won't be able to use the 1yr labor rule..hope this helps,

    The labor is for your future job that your company is offering (atleast technically). The LCA is based on your employer's address and NOT based on your address..As long as your employer doesn't move, it should be no problem. Of course, please check with an immigration attorney on this.:D

    My company wants me to relocate to another state. Because of which I need to re apply for new LC for green card processing. My current approved LC is EB3. My question: To be able to apply for EB2 position, can I use training & experience gained in my current company?

    Hi all
    I have I-140 approved from Company A . Company B applied for my H1B extn based on Company A's approved I-140 and got 3 years extension till 2011.

    My question:
    can I switch to company C now and get 3 more years extension again.? My I-140(company A) has not been revoked and priority date is not current.I want to start my PERM only after joining company C .
